Constitutional watchdog Katiba Institute has written to the Nairobi City County Secretary demanding full disclosure regarding the reported partnership between the National Government and Nairobi City County.
In a letter shared on its official X account on Tuesday, February 17, 2026, the institute stated that it is seeking comprehensive information on the much-anticipated cooperation agreement between the two levels of government.
According to Katiba Institute, the request is grounded in Article 35 of the Constitution and the Access to Information Act, which guarantee the public’s right to access information.
“I deserve to know: we have written to the Nairobi City County Secretary, under Article 35 of the Constitution and the Access to Information Act, to request full disclosure on the reported ‘partnership’ between the National Government and Nairobi City County in the performance of county functions. Katiba Institute is seeking clarity on its legal basis, scope, financing, agreements, and County Assembly involvement,” the institute stated.
The organization is demanding transparency on several critical aspects of the agreement, including:
-
The legal foundation of the partnership
-
The scope of functions to be covered
-
Financing arrangements
-
Existing agreements between the two governments
-
The role and approval of the County Assembly
The letter comes just hours before an anticipated signing ceremony at State House, where Nairobi Governor Johnson Sakaja is expected to formalize the agreement with President William Ruto.
The development has intensified debate over devolution, constitutional safeguards, and the balance of power between the national and county governments. Political observers note that transparency and public participation will likely be key issues as details of the agreement emerge.
