The Environment and Land Court sitting in Busia has delivered a significant ruling in ELC Petition No. E002 of 2024, a public interest case involving the protection of public land in Busia County.
In its ruling, the Court found the Governor of Busia County to be in contempt of court for failing to comply with conservatory orders previously issued in the matter. The conservatory orders had been granted pending the full hearing and determination of the petition and were intended to preserve the status of the disputed public land.
The Court emphasized that court orders are not optional and must be obeyed by all parties, including public officials, unless they are set aside, stayed, or varied by a court of competent jurisdiction. It noted that disobedience of court orders undermines the rule of law and the authority of the judiciary.
Having established that the conservatory orders were in force and had not been complied with, the Court formally cited the Governor for contempt. As a result, the judge directed that the matter proceed to the sentencing stage, where appropriate penalties will be considered in accordance with the law.
The Court further clarified that the substantive petition remains pending and will continue to be heard and determined on its merits. Additional directions are expected to be issued as the case progresses through the judicial process.
Members of the public have been advised that the matter is still ongoing and subject to further court proceedings. The ruling has drawn attention to the importance of compliance with judicial orders, particularly in cases involving public interest and the protection of public land.
